West Bengal Chief Minister Mamata Banerjee faced a significant blow as a two-member bench of the Calcutta High Court ordered the deletion of roughly five lakh backward class certificates granted since 2010. The majority of these persons are from the Muslim community and fall under the Other Backward Classes (OBC) classification. The OBCs can include persons from any religious community, but the procedure must be transparent. The Mandal Commission report recognised some Muslims, such as Ansaris in Uttar Pradesh, as eligible for reservation. In West Bengal, the committee in charge of selecting OBCs rushed to enforce a decision made by Banerjee during a public meeting. The judgement details how the government violated all requirements when providing certifications. Previously, the court ruled that the selection of many teachers violated established norms.
Beneficiaries of OBC certificates who are currently employed or pursuing education do not face any disadvantages, unlike teachers who were hired based on merit. The certificates’ validity ceased with the court’s ruling. Banerjee’s challenge to the Supreme Court’s declaration of the 77 classes as OBCs will be difficult due to the secretive nature of the process. The Trinamool Congress government should re-select eligible classes for OBC reservations. Reservation is an option if a specific group of socially and educationally disadvantaged persons has no representation in government employment or academic institutions. She should be grateful to the court for not nullifying the certificates retroactively.
It’s important to consider that the state administration and high court have been at odds for a long time. After multiple decisions against the government, one judge resigned and joined the BJP. He is now running for Lok Sabha. On his day of superannuation, another individual admitted to being a member of the RSS and expressed his willingness to return to the group and accept any responsibilities. This raises issues about the judges’ verdicts.
The chief minister must uphold the Constitution while ruling the state.
